In this Privacy Policy, “we” and “us” refers to Stickshift Entertainment Pty Ltd (ACN 687 958 603) (Stickshift) and “you” refers to any individual about whom we collect personal information.

What information do we collect about you?

When you use Plonk!, we may also collect gameplay data such as profile name and high scores as described in the Plonk! User Data section below.

We may obtain personal information about you when you visit our website, use Stickshift’s game known as Plonk! (Plonk!) and when you contact us or interact with us in some other way.

You may provide us with basic information such as your name, date of birth, phone number, postal address and email address.

We may also collect additional personal information that you provide to us, or authorise us to collect, as part of your interactions and transactions with us.

Sensitive information such as health information is only collected if we have your express permission to do so.

How do we collect your personal information?

Direct interactions:

We collect information from you in a variety of ways, including when you interact with us electronically or in person, when you access our website, interact on our social media pages, enter a competition, use a contact form, telephone us or send us an email and when we provide our products or services to you. We may also collect personal information about you from other sources, such as third parties such as data brokers or referral sources.

Automated technologies or interactions:

We use cookies, web analytics tools and similar tracking technologies to track the activity on our website, for better targeting advertisements and for marketing purposes. Cookies are digital identifiers that are stored on your computer. We may collect certain information such as your device type, browser type, IP address, pages you have accessed on our websites and third-party websites as well as accessing cookies stored on your computer that were created by third parties. It is possible that you may be either directly or indirectly identifiable from this information.

Google Analytics:

This website uses Google Analytics 4 (GA4), a web analytics service provided by Google LLC. Google Analytics uses cookies and similar technologies to collect and analyse information about how visitors use this website, including pages visited, time spent on the site, and general geographic location (at the city or country level). This data is used to help us understand and improve our website. The information generated by cookies about your use of the website is generally transmitted to and stored by Google on servers in the United States. Google may also transfer this information to third parties where required to do so by law, or where such third parties process the information on Google's behalf. Automated Decision-Making

We do not use automated decision-making processes to make decisions about you.

Plonk! User Data

What gameplay data do we collect?

When you use the "Challenge Mode" feature within Plonk!, we collect limited gameplay data consisting of your profile name and your highest score (completion time). This data is only collected after successful authentication and is processed via our backend provider brainCloud.

How do we use your gameplay data?

We use this data solely to generate and display leaderboards and allow performance comparison between players. Only top 10 scores may be displayed. This data is not used for advertising, profiling, or automated decision-making.

How can you request deletion of your gameplay data?

You are able to delete their gameplay data from within the game using the delete icon displayed on the leaderboard. You can also delete all of your gameplay data both internally and stored on the leaderboard within the settings menu by pressing the Delete All Data button. If you are having difficulty with the deletion of your data, please email sean@t-da.io with the subject line “Plonk Data Delete Request” and include your Meta user name in the email.

Why do we collect and use your personal information?

We collect personal information as reasonably necessary to carry out our business, which may include (but is not limited to):

• delivery of our products and services;
• contacting and communicating with you including responding to queries, complaints and feedback from you;
• providing after-sale customer service;
• to ensure the proper functioning of our website, our business and operations;
• to assist us with marketing, product and service development and research requirements;
• to manage our relationship with you; or
• advertising and marketing our products and services.

Who do we disclose your personal information to?

• We may disclose personal information to third parties who we engage to help run our business, or as necessary to provide the service or product that you have requested.
• From time to time we may need to disclose personal information where the law requires us to do so.
• If there is a change of control in our business (for example a sale of the business) your personal information could be disclosed to a potential purchaser under a confidentiality agreement.
• We may share your personal information with related and affiliated companies located in Australia and overseas.
• We may use and disclose your personal information for other purposes explained at the time of collection with your consent.

Do we use or disclose your personal information for direct marketing?

We may use or disclose personal information (other than sensitive information) collected from you for the purpose of our direct marketing, including but not limited to marketing campaigns by post, email, SMS, telemarketing and social media (Direct Marketing Communications) where you would reasonably expect the information to be used or disclosed for this purpose.

We collect your Personal Information for the purpose of direct marketing from you directly unless it is unreasonable or impracticable to do so. Where we obtain information from third parties we require them to confirm that your personal information has been lawfully collected and that you have consented to it being shared and used for direct marketing purposes.

We may use or disclose Personal Information (other than Sensitive Information) collected in other circumstances, for the purpose of direct marketing subject to, and in accordance with, the law. This may involve obtaining your consent where practicable. Sensitive Information will only be used for the purpose of direct marketing if you have expressly consented to this.

If at any time you do not wish to receive any further Direct Marketing Communications, you may do this at any time by using the "unsubscribe" facility included in the Direct Marketing Communication or by contacting us - you will find the details at the end of this document.

If you opt-out of receiving our Direct Marketing Communications, we may still contact you in relation to our ongoing relationship with you.

Do we disclose your personal information overseas?

Any personal information collected and held by us may be disclosed to, and held at, a destination outside Australia.

By submitting your personal information to us, you expressly consent to the disclosure, transfer, storing or processing of your personal information outside of Australia. We take such steps as are reasonable in the circumstances to ensure that any recipients of your personal information outside of Australia are bound by privacy principles equivalent to those contained within the Privacy Act or agree to meet the requirements of the Privacy Act.

If you do not agree to the transfer of your personal information outside of Australia, please either do not provide us with your personal information or contact us via the details set out at the end of this document.

Can you deal with us anonymously or use a pseudonym?

Providing us with your personal information is optional and you may be able to remain anonymous or use a pseudonym when interacting with us. However, it may not always be possible for this to occur especially if we are providing you with products or services. We will inform you if you are unable to remain anonymous or use a pseudonym when dealing with us.

How do we hold your information?

We maintain physical, electronic and managerial security to safeguard and secure your personal information.

To the extent permitted by law, we take reasonable steps to destroy or permanently de-identify personal information if it is no longer needed for its purpose of collection.

Legislation requires us to notify you and take other steps if we learn that there has been a notifiable data breach that has or may involve your personal information.
